1. Legal notice

Website publisher: MALYA TRAVEL, a limited liability company (SARL) with share capital of 1,000,000 FCFA, registered with the Trade and Personal Property Credit Register (RCCM) of the Abidjan Commercial Court under number CI-ABJ-03-2025-B12-01987 (registered on 11 April 2025).

Registered office: Abidjan, Cocody Angré, terminus 81/82, lot 0, îlot 79 bis, Côte d'Ivoire.

Corporate purpose: organisation of trips; purchase and sale of travel tickets; travel, holiday, cruise and leisure services and products.

2. Terms and conditions of sale

These terms apply to every service sold by MALYA TRAVEL (trips, holidays, tickets, visas, insurance, excursions). Any booking constitutes acceptance of these terms and of the specific conditions set out in the firm quote.

2.1 Quotes. The estimates shown on the website, in the PDF guides and in automatic emails are indicative: they depend on availability and on the rates of the day. Only the firm quote sent by an advisor is binding on MALYA TRAVEL, for the period of validity stated in it. Photos are for illustration purposes only.

2.2 Booking. A booking becomes final upon receipt of the deposit stated in the firm quote and, where applicable, of the required passport copies. MALYA TRAVEL then sends a written confirmation (email or WhatsApp).

2.3 Prices. Prices are expressed in CFA francs (XOF), per person, based on a double room, unless otherwise stated. Amounts in euros, dollars or other currencies are given for information only. They include only the services listed in the firm quote. Unless otherwise stated, the following are not included: visa fees, insurance, meals and drinks not mentioned, tips, personal expenses and optional excursions.

2.4 Price revisions. Until tickets are issued, airfares, taxes and fuel surcharges as well as exchange rates may change. Any increase will be notified to the client before confirmation; if it exceeds 10% of the total price, the client may cancel free of charge within 7 days of being informed.

2.5 Payment. Payment is made in one or more instalments according to the schedule in the firm quote: online by mobile money (Orange Money, MTN MoMo, Moov Money, Wave) or bank card via the secure CinetPay platform, by bank transfer or at our agency. The balance must be paid no later than the date stated in the firm quote; failing this, MALYA TRAVEL may consider the booking cancelled by the client, with the fees in article 2.7 applying. Online payments never pass through MALYA TRAVEL's servers: no bank details are stored there.

2.6 Changes by the client. Any request for changes (dates, names, hotel, package) is considered subject to availability; fees charged by suppliers (airlines, hotels) are passed on to the client, together with an administration fee specified at the time of the request. A passenger's name can no longer be changed once the ticket has been issued.

2.7 Cancellation by the client. Any cancellation must be notified in writing (email or WhatsApp). Unless more favourable specific conditions are stated in the firm quote, the following fees apply, calculated on the total price of the trip:

• more than 60 days before departure: administration fees and amounts not refundable by suppliers (issued air tickets, visas, hotel deposits);
• 60 to 31 days: 25% of the total price, with a minimum of the non-refundable amounts;
• 30 to 15 days: 50%;
• 14 to 8 days: 75%;
• less than 8 days or no-show: 100%.

Visa, insurance and administration fees are never refundable. Air tickets are subject to the airline's conditions (often non-refundable).

2.8 Cancellation or changes by MALYA TRAVEL. If a trip has to be cancelled by MALYA TRAVEL (minimum number of participants not reached for a group departure, force majeure, decision by an authority), the client will be offered a replacement trip or a full refund of the sums paid, with no further compensation where the cancellation results from force majeure. The minimum number of participants for a group departure is stated in the firm quote.

2.9 Entry requirements. Travellers are responsible for the validity of their passport (generally six months after return), for obtaining their visas and for complying with health requirements (vaccinations, yellow fever certificate). The “Visas & entry” information on the website is given for guidance only and may change; MALYA TRAVEL assists clients with their applications but cannot be held liable for a visa or boarding refusal due to a missing or non-compliant document.

2.10 Insurance. Travel insurance covering assistance, repatriation, medical expenses and cancellation is strongly recommended and sometimes mandatory (Schengen visa, Umrah). It can be taken out through MALYA TRAVEL.

2.11 Liability. MALYA TRAVEL is responsible for the proper performance of the services sold, within the limits of the international conventions applicable to air transport. It cannot be held liable in the event of fault by the traveller, the act of a third party unconnected with the provision of the services, or force majeure (natural disaster, political unrest, epidemic, strike, administrative decision). Flight times are given for information only and may be changed by the airline.

2.12 Complaints. Any complaint must be sent in writing to booking@malyatravel.com within 30 days of return, together with supporting documents. MALYA TRAVEL undertakes to respond within 30 days.

2.13 Governing law and disputes. These terms are governed by Ivorian law. In the event of a dispute, the parties will first seek an amicable solution; failing this, the Abidjan Commercial Court shall have sole jurisdiction.

3. Privacy policy

Data collected: name, title, email, phone or WhatsApp number, nationality, travel plans and, when booking, the passport details required for tickets and visas.

Use: preparing quotes, organising trips, sending the guides requested and, if you have agreed, the newsletter. Data is shared only with the necessary service providers (airlines, hotels, consular authorities, the Brevo email platform, the CinetPay payment platform). It is never sold.

Retention period: 3 years after the last contact for prospects; the statutory accounting retention period for clients.

Your rights: in accordance with Ivorian Law No. 2013-450 of 19 June 2013 on the protection of personal data, you have the right to access, rectify, object to and erase your data. Write to booking@malyatravel.com. You can also unsubscribe from the newsletter using the link in every email.

4. Cookies and audience measurement

Internal audience measurement (no consent required): to improve the website, we count visits anonymously (pages viewed, referral source, device type, clicks to WhatsApp). No IP address or personal data is recorded; a random identifier is kept in your browser.

Advertising cookies (with your consent): if you click “Accept” in the banner, the Meta pixel (Facebook and Instagram) measures the effectiveness of our ads and allows us to show you our offers on these networks. Without your consent, it is never loaded. Change my choice

App notifications: if you turn them on, we only keep the technical subscription address provided by your browser (no name, e-mail or phone number) and the site language, to send you our offers and travel news (2 to 4 a month at most). You can turn them off at any time in your phone or browser settings.
